1. Introduction and Acceptance
Welcome to Mile High Ministries. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Mile High Ministries, a Colorado 501(c)(3) nonprofit organization (Tax ID 84-0782214).
Our Mission
Mile High Ministries seeks God’s peace for our city through the creative, compassionate, and prayerful development of people and communities. Since 1988, we have put our mission into action through supportive housing, leadership development, and local initiatives that strengthen our neighbors’ capacity to thrive.
Agreement to Terms
By accessing our website at milehighmin.org, using our services, participating in our programs, making donations, volunteering, or subscribing to our communications, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you may not use our services or access our website.
Authority to Accept
If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Our Right to Modify
We reserve the right to modify these Terms at any time. Material changes will be communicated through our website, email, or text message to affected users. Your continued use of our services after changes become effective constitutes acceptance of the modified Terms.
2. Definitions
For purposes of these Terms:
- “Mile High Ministries,” “we,” “us,” or “our” refers to Mile High Ministries, Inc., a Colorado nonprofit corporation.
- “You” or “your” refers to any individual or organization accessing our services, website, or programs.
- “Services” includes all programs, activities, communications, and offerings provided by Mile High Ministries, including:
- Joshua Station (transitional housing program for families experiencing homelessness)
- Clara Brown Commons (affordable housing community)
- Abundant Ground (land and building development initiative)
- Website and digital communications
- Fundraising and donor services
- Volunteer opportunities
- Community events and programs
- “Program Participant” refers to any individual or family enrolled in our housing or support programs.
- “Donor” refers to any individual or organization that makes financial contributions to Mile High Ministries.
- “Volunteer” refers to any individual providing unpaid services to Mile High Ministries.
- “Content” includes all text, images, videos, audio, data, information, and materials available through our services.
3. Who May Use Our Services
Age Requirements
General Website Use: You must be at least 13 years old to use our website independently.
Program Services: Age requirements vary by program. Joshua Station serves families with children. Clara Brown Commons has minimum age requirements for primary leaseholders as specified in housing agreements.
Donations: You must be at least 18 years old (or the age of majority in your jurisdiction) to make donations independently.
Volunteers: Minimum age requirements vary by volunteer role. Youth volunteers under 18 require parental consent.
Legal Capacity
You represent that you have the legal capacity to enter into these Terms. If you are accepting these Terms on behalf of a household or family, you represent that you are authorized to bind all household members to these Terms as they relate to program participation.
Account Security
If you create an account with us (for donations, volunteer coordination, or other purposes), you are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Program Services and Eligibility
Application Process
Application for our programs (Joshua Station, Clara Brown Commons) is subject to eligibility requirements, availability, and selection criteria established by Mile High Ministries and applicable funding sources.
We do not guarantee:
- Acceptance into any program
- Specific timing for placement
- Particular housing units or locations
Eligibility Determinations
Program eligibility is determined based on:
- Income requirements
- Family composition
- Housing history
- Legal status
- Other criteria specific to each program and funding source
Mile High Ministries reserves the right to:
- Request documentation to verify eligibility
- Decline applications that do not meet program requirements
- Establish waiting lists when programs are at capacity
- Modify eligibility criteria to comply with funding requirements
Program Participation Requirements
If accepted into a program, you agree to:
- Comply with all program rules, housing agreements, and community standards
- Participate in required case management and support services
- Maintain your housing unit in accordance with lease or residency agreements
- Respect the rights and dignity of other residents, staff, and volunteers
- Attend required meetings, appointments, and program activities
- Work toward self-sufficiency goals as outlined in your service plan
No Guarantee of Outcomes
While we provide comprehensive support services, we cannot guarantee:
- Specific outcomes (employment, housing stability, etc.)
- Results from referrals to external service providers
- Resolution of all challenges you may face
Your success depends on many factors, including your active participation, external circumstances, and coordination with multiple service systems.
Program Termination
Mile High Ministries may terminate program participation for:
- Violations of program rules or housing agreements
- Threatening or violent behavior
- Illegal activity on program premises
- Non-compliance with program requirements
- Other reasons specified in program-specific agreements
Termination procedures will follow applicable laws, lease agreements, and due process requirements.
5. Text Message Communications
Your Consent to Receive Text Messages
By providing your mobile phone number to Mile High Ministries and opting in to receive text messages, you expressly consent to receiving text messages from us at the number you provide.
Types of messages you may receive:
- Program Services: Appointment reminders, program updates, case management communications, emergency notifications
- Community Engagement: Event invitations, volunteer opportunities, community updates
- Fundraising: Donation appeals, impact updates, giving campaigns (only if you specifically opt in)
- Administrative: Account notifications, service announcements
Message Frequency and Content
Program Participants: Message frequency varies based on your current program participation and service needs. You may receive multiple messages per week during active case management.
Supporters and Volunteers: Typically 2-4 messages per month for general updates and event invitations.
Emergency Communications: Sent only when necessary for health, safety, or critical program information to current program participants.
Message Content Standards: All messages will be:
- Relevant to your relationship with Mile High Ministries
- Appropriate for our mission and your interests
- Free from spam, advertisements, or third-party promotions
- Sent only to those who have provided consent
Carrier Charges and Technical Requirements
Your Responsibility:
- Message and data rates may apply according to your mobile carrier plan
- Standard messaging rates from your wireless carrier apply to all messages
- Mile High Ministries is not responsible for carrier charges
Technical Requirements:
- Compatible mobile device with active service
- Mobile carrier that supports text messaging
- Accurate and current phone number on file
- Notification to us of any phone number changes
Your Right to Opt Out
You may stop receiving text messages at any time using any of these methods:

Opt-Out Processing Timeline
- Processing Time: We will remove you from messaging lists within 10 business days
- Confirmation: You will receive one final message confirming your opt-out request
- Future Messages: After confirmation, no additional promotional or general messages will be sent
- Emergency Exception: Current program participants may still receive critical safety or emergency notifications
IMPORTANT: Opting out of text messages does NOT affect:
- Your ability to participate in Mile High Ministries programs
- Your eligibility for housing or support services
- Your case management or other program benefits
- Your right to make donations or volunteer
Service Limitations and Liability for Text Messaging
Delivery Limitations:
Mile High Ministries makes reasonable efforts to deliver text messages reliably, but we cannot guarantee delivery due to factors beyond our control:
- Mobile carrier network outages or disruptions
- Device technical problems or compatibility issues
- Phone number changes or service disconnections
- System maintenance or technical updates
- Wireless provider filtering or blocking
Limited Liability:
By using our text messaging services, you acknowledge and agree that:
- Message delays or failures may occur without our fault
- Mile High Ministries is not liable for consequences of delayed, failed, or undelivered messages
- Text messaging should not be your sole method for time-sensitive communications
- For urgent matters, you should call us directly at (303) 839-5198
NOT Emergency Services:
Text messaging is NOT intended for emergency communications requiring immediate response. In emergencies:
- Call 911 for police, fire, or medical emergencies
- Call (303) 839-5198 during business hours for urgent program matters
- Contact your local emergency services for immediate safety concerns
Data Handling for Text Messaging
Text message communications are subject to our Privacy Policy. We:
- Collect and store your mobile number and consent records
- Protect your information with appropriate security measures
- Will NEVER share your mobile number with third parties for their marketing
- Maintain records as required by applicable regulations
- Process opt-out requests permanently

8. Volunteer Services
Volunteer Relationship
Independent Relationship: Volunteers are not employees, agents, or representatives of Mile High Ministries. The volunteer relationship does NOT create:
- Employment rights
- Employee benefits
- Workers’ compensation coverage (in most circumstances)
- Authority to bind Mile High Ministries in contracts
At-Will Relationship: Either you or Mile High Ministries may terminate the volunteer relationship at any time, with or without cause or notice.
Volunteer Requirements
Before Volunteering:
- Complete volunteer application and orientation
- Provide emergency contact information
- Sign liability waivers and photo release forms
- Complete background checks (for certain volunteer roles involving vulnerable populations)
- Provide proof of required vaccinations or health screenings (for certain roles)
During Volunteer Service:
- Follow all Mile High Ministries policies and procedures
- Respect confidentiality of program participants and organizational information
- Maintain appropriate boundaries with program participants
- Report concerns about safety, abuse, or policy violations to staff immediately
- Use provided equipment and resources appropriately
- Represent Mile High Ministries professionally
Background Checks
Certain volunteer positions require background checks, including:
- Volunteers working directly with children or vulnerable adults
- Volunteers with access to financial information or systems
- Volunteers with keys or unsupervised access to facilities
- Other positions as determined by Mile High Ministries
By volunteering in these positions, you consent to background checks and agree to provide necessary information.
Liability and Insurance
Your Assumption of Risk: Volunteering may involve physical activity, interaction with vulnerable populations, and other risks. You voluntarily assume all risks associated with volunteer activities.
Our Insurance: Mile High Ministries maintains general liability insurance. This coverage may provide limited protection for volunteers in some circumstances, but is not a substitute for your personal insurance.
Your Insurance: You are responsible for maintaining your own health, auto, and other appropriate insurance coverage.
Confidentiality
Volunteers may have access to confidential information about:
- Program participants and their personal circumstances
- Donors and their giving history
- Organizational strategies and financial information
- Other sensitive matters
You agree to:
- Keep all confidential information strictly confidential
- Not disclose confidential information to anyone outside Mile High Ministries
- Not use confidential information for personal benefit
- Maintain confidentiality even after your volunteer service ends
Volunteer Conduct and Termination
We may terminate your volunteer service immediately for:
- Violation of policies or these Terms
- Inappropriate behavior toward staff, participants, or other volunteers
- Breach of confidentiality
- Criminal activity
- Failure to complete required training or background checks
- Other reasons at our sole discretion

We do not guarantee:
- Acceptance into programs
- Specific housing placements or timelines
- Success in achieving self-sufficiency goals
- Outcomes from referrals to external services
- Resolution of legal, health, employment, or other personal challenges
- Website availability or functionality
Information Accuracy
While we strive for accuracy, we do not warrant that:
- Website content is always current or error-free
- Referrals to external resources will meet your needs
- Program information will not change
- All services will remain available
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MILE HIGH MINISTRIES AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR:

- Financial losses
- Employment issues
- Personal injury (except as caused by our gross negligence)

Total Liability: Our total liability to you for any claims arising from these Terms or our services shall not exceed the amount you have paid to Mile High Ministries in the 12 months preceding the claim (or $100 if you have not made payments).
Exceptions to Limitations
These limitations do NOT apply to:
- Liability that cannot be excluded under applicable law
- Death or personal injury caused by our gross negligence or willful misconduct
- Fraud or fraudulent misrepresentation
- Violations of your statutory rights that cannot be waived

13. Indemnification

- Your negligent or intentional misconduct
Our Right to Control Defense
If we are sued because of your actions, we reserve the right to:

- Require your cooperation in the defense

14. Dispute Resolution

Before pursuing formal legal action, you agree to:

Most disputes can be resolved through direct communication.

Jurisdiction and Venue
Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Denver, Colorado. You consent to personal jurisdiction and venue in these courts.
Waiver of Class Actions
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Arbitration (Optional)
For certain disputes, the parties may mutually agree to binding arbitration under the rules of the American Arbitration Association. Arbitration is not mandatory unless specifically agreed to by both parties.
Exceptions to Dispute Resolution
These dispute resolution provisions do NOT apply to:
- Claims for injunctive or equitable relief
- Intellectual property disputes
- Small claims court actions
- Housing-related disputes subject to landlord-tenant law
15. Changes to Terms
Our Right to Modify
Mile High Ministries reserves the right to modify, amend, or replace these Terms at any time for reasons including:
- Changes in applicable laws or regulations
- Changes in our services or programs
- Improvement of user protections
- Clarification of existing terms
Notice of Material Changes
For material changes affecting your rights or obligations, we will provide notice through:
- Prominent website announcement
- Email to registered users
- Text message to messaging subscribers
- Direct notice to active program participants
Non-material changes (formatting, clarifications, corrections) will be posted without additional notice.
Effective Date of Changes
Changes become effective:
- For material changes: 30 days after notice is provided
- For non-material changes: Immediately upon posting
Your Options
If you disagree with changes:
- You may discontinue using our services
- For program participants: Changes do not affect your existing housing agreements or program participation rights established in program-specific contracts
- For donors and supporters: You may opt out of communications
- For volunteers: You may discontinue volunteer service
Continued use of our services after changes become effective constitutes acceptance of modified Terms.
16. Miscellaneous Provisions
Entire Agreement
These Terms, together with our Privacy Policy and any program-specific agreements, constitute the entire agreement between you and Mile High Ministries regarding your use of our services.
Severability
If any provision of these Terms is found to be unenforceable or invalid:
- That provision will be modified to reflect the parties’ intention as closely as possible
- All other provisions will remain in full effect
- The unenforceable provision will not affect the validity of the remaining Terms
Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future. Any waiver must be in writing and signed by an authorized representative of Mile High Ministries.
Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms without our written consent.
Mile High Ministries may assign these Terms in connection with a merger, acquisition, or sale of assets, or to any affiliated organization.
Headings
Section headings in these Terms are for convenience only and do not affect interpretation.
Survival
Provisions that by their nature should survive termination of these Terms shall survive, including:
- Intellectual property rights
- Disclaimers and limitations of liability
- Indemnification obligations
- Dispute resolution provisions
- Confidentiality obligations
Language
These Terms are drafted in English. Any translations are provided for convenience only. In case of conflicts between versions, the English version controls.
Force Majeure
Mile High Ministries is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including:
- Natural disasters
- Public health emergencies
- Acts of government
- War or terrorism
- Labor disputes
- Internet or utility failures

For Program Participants: Your participation in specific programs is also governed by program-specific agreements, lease agreements, and residency rules. In case of conflicts, program-specific agreements control for matters related to housing and program requirements.
For Volunteers: Your volunteer service is also governed by volunteer agreements, liability waivers, and position-specific requirements.
For Donors: Your donations are also subject to our gift acceptance policies and tax compliance requirements.
